Terms of Service – SALTT Australia

Welcome to getsaltt.com.au (the Site), operated by THE SOURCE DIST. PTY LTD (SALTT, we, us, our). By accessing or purchasing from the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Australian Consumer Law (ACL): Nothing in these Terms limits your non-excludable rights under the ACL. If a product is faulty, unsafe, not fit for purpose or doesn’t match its description, you may be entitled to a repair, replacement or refund. 

1. Using the Site

1.1 Eligibility: You must be at least 18 years old, or use the Site under the supervision of a parent/guardian.
1.2 Your Account: Keep your login secure and your details accurate. You’re responsible for all activity under your account.
1.3 Accepting the Terms: By clicking “Checkout”, “Pay now”, creating an account, or otherwise using the Site, you agree to these Terms.

2. Products, Information & Health

2.1 Product information: We aim for accuracy, but minor variations in packaging or flavour descriptions can occur.
2.2 Health disclaimer: Our electrolytes and related products are not intended to diagnose, treat, cure or prevent any disease. Always check ingredients for allergies and consult a healthcare professional if you have medical conditions, are pregnant/breastfeeding, or use prescription medicines.
2.3 Use as directed: Follow label instructions and do not exceed recommended intake.

3. Pricing, Taxes & Payment

3.1 Prices: All prices are shown in AUD and include GST unless stated otherwise. We may change prices at any time before you place an order. Businesses must display total prices including unavoidable fees. 
3.2 Payments: We accept major cards and available third-party payment methods shown at checkout. You authorise us (and our payment providers) to take payment for your order, including any shipping charges.
3.3 Errors: If a pricing or listing error occurs, we may cancel and refund the order before dispatch.

4. Orders, Shipping & Risk

4.1 Order acceptance: Your order is an offer to buy; we’ll confirm acceptance by email when we ship. We may decline or cancel due to stock issues, suspected fraud, or errors.
4.2 Dispatch & delivery: Timeframes provided at checkout are estimates. We’ll act reasonably to meet them. Systemic delivery failures or misleading delivery claims can breach the ACL; we aim to avoid these and keep you informed. 
4.3 Risk & title: Risk passes on delivery to your nominated address; title passes once payment clears. Please track and secure parcels.

5. Returns, Refunds & Consumer Guarantees

5.1 Consumer guarantees: If a product fails to meet ACL consumer guarantees, contact us—remedies may include repair, replacement, or refund depending on the issue’s severity. 
5.2 Change of mind: For hygiene and safety, we only accept unopened returns within 30 days (you cover return postage) unless otherwise required by the ACL.
5.3 Damaged, faulty or incorrect items: Notify us within 7 days of delivery with your order number and photos. We’ll organise a replacement, refund or repair, and cover reasonable return shipping where required.
5.4 How to start a return: Email support@getsaltt.com.au. We’ll provide instructions and, if applicable, a pre-paid label.
5.5 Policy integrity: We won’t use terms that mislead consumers about their ACL rights. 

6. Subscriptions (if enabled)

6.1 Billing cycle: Subscriptions renew automatically at the interval shown at purchase until you pause or cancel.
6.2 Changes & cancellations: Manage from your account at least 48 hours before the next renewal to avoid the next charge.
6.3 Failed payments: We may retry failed payments or suspend/terminate the subscription.

Note on unfair terms: We do not rely on unfair contract terms in standard form consumer contracts; these are illegal and attract penalties from 9 November 2023. 

7. Promotions, Bundles & Gifts

7.1 Promo codes: One per order unless stated. Non-transferable, no cash value, and subject to expiry and exclusions.
7.2 Bundles: For change-of-mind returns, bundles must be returned complete and unopened (ACL rights still apply).
7.3 Gifts with purchase: If returning for change of mind, include any free gift(s) to qualify for a full refund.

8. User Content (Reviews, Q&A, Messages)

8.1 Your licence to us: By posting reviews or content, you grant us a worldwide, royalty-free licence to use, reproduce and display that content for marketing and operational purposes.
8.2 House rules: No illegal, infringing, defamatory, obscene, or misleading content; no spam or commercial solicitations. We may moderate or remove content at our discretion.

9. Intellectual Property

9.1 Our IP: All Site content (text, graphics, logos, product names, images) is owned by us or our licensors and protected by applicable IP laws.
9.2 Limited licence: You may use the Site for personal, non-commercial purposes. No reproduction, distribution, modification or derivative use without permission.

10. Acceptable Use

You agree not to: (a) misuse the Site (malware, scraping, bulk data extraction); (b) interfere with security or access controls; (c) use the Site for unlawful purposes; or (d) attempt to reverse engineer any part of the Site.

11. Third-Party Services & Links

We use third-party platforms (e.g., payment gateways, couriers). Their terms and privacy practices apply in addition to ours. We’re not responsible for external sites we link to.

12. Limitation of Liability

To the maximum extent permitted by law, we exclude all warranties, representations and conditions not expressly set out in these Terms. Where liability cannot be excluded under the ACL, our liability is limited to the remedies required by law (e.g., replacement or refund for major failures). 

13. Indemnity

You indemnify us (and our officers, employees and agents) against losses arising from your breach of these Terms or misuse of the Site, except to the extent caused by our negligence or breach of the ACL.

14. Privacy

Our Privacy Policy explains how we collect, use and disclose personal information. By using the Site, you consent to our privacy practices.

15. Changes to the Site or These Terms

We may update products, features and these Terms from time to time. Changes take effect when posted on the Site and apply to orders placed after the change. For substantive changes to subscriptions, we’ll provide reasonable notice.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of Victoria, Australia, and the Commonwealth laws applicable there. You submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.
